LANAK & HANNA OBTAINS A DISMISSAL OF CASE AT OUTSET OF TRIAL

Lanak & Hanna Senior Counsel Mac Cabal secured a dismissal of a case at the outset of trial.  At issue, was a long-running dispute between a taxpayer advocate and a general contractor over baseless allegations that the general contractor had improperly obtained a public works bid for a local school district.

After years of contentious litigation, Mr. Cabal convinced the Court to address the legal issue of statute of limitations at the outset of trial, rather than at the end.  The Court agreed with Mr. Cabal and accepted his argument that by failing to timely pursue a legal validation action to challenge the original bid, the taxpayer had essentially waived his claims of bidding improprieties.  As such, the Court dismissed the case in favor of the client and awarded costs.
