Lanak & Hanna Secures Major Trademark Win for National Sports Association

Congratulations to Trial Attorney and Principal Mac W. Cabal for winning a trademark infringement case for the client. The client was a prominent non-profit sports association that hosted and managed a well-known and attended national athletic tournament in Southern California over the course of twenty years. The tournament featured thousands of athletes and hundreds of teams from all across America. Two directors of the association claimed trademark and ownership rights over the tournament, its uniquely designed trademark, and its bank accounts, among other things.

After an eight-day trial, featuring twelve witnesses and nearly two hundred exhibits, the court found in favor of the client on all counts. The court ruled that the adverse parties infringed upon the client’s common law trademark rights despite holding their own Federal and California registered trademarks for the tournament. The court further awarded hundreds of thousands of dollars in monetary damages in favor of the client. The court also ordered injunctive relief in favor of the client, including ordering the adverse parties to turn over the username and password of the tournament website and barring the adverse parties from setting up a competing tournament using the infringed trademark. You might say it was a grand slam victory for the client.
