Congratulations to Attorney David R. Johnson for obtaining a complete victory on a performance bond issued by a surety client. The project’s owner asserted a high six figure claim against a Lanak & Hanna surety client in state court litigation in Northern Nevada. After evaluating the actions of the claimant and the bond’s terms, Mr. Johnson filed a motion for summary judgment against the owner, which was strenuously opposed by the owner. In its approximately 22 pages addressing the motion, the court agreed with Mr. Johnson’s analysis and determined that the owner did not comply with the bond requirements. The court granted summary judgment in favor of the surety client, and dismissed it from the case.
