In an expedited jury trial, Lanak & Hanna defended a surety against a homeowner’s claim for recovery on a contractor’s license bond for violations of the Business & Profession Code sections requiring written home improvement contracts.
The jury was persuaded by L&H that the homeowner was a sophisticated consumer and not in the class of persons which the statutes were most clearly enacted to protect. The jury was further persuaded that no violation caused damages to the homeowner, and Judgment was awarded in favor of the surety.
