Following an appeal taken by the surety’s principal from the trial court’s order denying the principal’s motion to vacate renewal of the surety’s judgment, Associate Attorney Thomas Padian successfully convinced a three-judge Appellate panel that the surety had properly served its notice of renewal of judgment and of the renewal itself and that the principal’s motion to vacate was defectively filed.
In a published opinion, the Second District Court of Appeal in Los Angeles affirmed the trial court’s order denying the bond principal’s motion to vacate the renewal of the judgment and awarded the surety its costs on appeal. The opinion solidifies the rights of judgment creditors to rely on proper service of process for obtaining judgments against debtors.
