Congratulations to Attorney Emily C. Gifford for securing a low settlement, of less than $5,000, in a pre-litigation employment case! Lanak & Hanna’s client received a demand letter from a disgruntled ex-employee who claimed his case was worth over $150,000. During negotiations, the client received letters from various state agencies looking for the ex-employee, and Ms. Gifford and the client launched an investigation into him. Ms. Gifford found the ex-employee had an extensive criminal record, including recent charges for fraud and other felonies. This also proved that the ex-employee lied to the client on his job application, which severely discredited him. Like many employment cases, some of the ex-employee’s claims came down to a he-said/he-said situation. Once the ex-employee was discredited, his claims lost their value. As a result, the ex-employee was forced to settle at a value the client set.
